These Terms & Conditions govern all advertising placed with The Border Pulse (“Publisher”), whether on its website, mobile apps, social media platforms, print edition, or other related media platforms. By signing an Advertising Package Selection form, submitting ad materials, or otherwise engaging Publisher’s advertising services, the party purchasing advertising (“Advertiser”) agrees to be bound by these Terms & Conditions.

These Terms & Conditions apply alongside, and form part of, any signed Advertising Agreement or Package Selection form. Where a specific rate, package, term length, or start date is agreed in writing with an Advertiser, that specific agreement governs; these Terms & Conditions govern everything else.

1. Advertising Packages & Rates

Current advertising packages, placements, and rates are set out in Publisher’s rate card, updated from time to time, and in the Advertising Package Selection form signed by the Advertiser. Packages are subject to availability. Placement is reserved upon receipt of a signed agreement and the first month’s payment.

2. Discounts

  • Combo Discount: A 5% discount applies where combined advertising totals $300/month or more.
  • First-in-Category Discount: 5% off card rate, available only to the first Advertiser signed in a given business category, and only on Premium or Elite packages. Requires a minimum 6-month term with 60 days’ written cancellation notice. Stacks with the 6-month or 12-month term discounts below.
  • 6-Month Term Discount: An additional 5% discount for a 6-month contract term.
  • 12-Month Term Discount: An additional 10% discount for a 12-month contract term.
  • Maximum combined discount: 15% off (5% First-in-Category + 10% for a 12-month term), available on Premium or Elite packages only.

Discounts cannot be combined with other promotional or sale pricing unless specifically noted in writing. Any current sale pricing will be documented, including the applicable terms and expiry date.

3. Payment Terms

Invoices are issued on either the 1st or 15th day of each calendar month, covering the advertising services to be rendered during that billing period. Invoices issued on the 15th are due by the 1st of the following month. Invoices issued on the 1st are due by the 15th of that same month. Payment for the first month is due upon signing.

Example: an invoice issued August 15 is due by September 1, covering September advertising. An invoice issued September 1 is due by September 15, continuing the mid-month advertising cycle. Advertising is therefore always paid one month ahead. There is no charge for the days between an ad’s start date and the beginning of the next full payment period if the ad goes live a few days early.

Overdue accounts may be subject to a late fee of 2% per month (24% annually). If payment is not received by the applicable due date, the advertisement will be removed from publication and will remain down until payment is received in full. Payments are accepted via e-transfer, cheque, or cash; a receipt will be provided upon payment. GST will be applied to the advertising rate.

4. Advertiser Responsibilities

Unless otherwise agreed in writing, the Advertiser shall:

  • Provide or approve all ad materials by the submission deadline, unless agreed otherwise.
  • Ensure that all content complies with applicable laws, copyright, and advertising standards.
  • Indemnify and hold The Border Pulse harmless against any claims arising from the advertisement’s content.

5. Publisher Rights

The Border Pulse reserves the right to:

  • Reject or remove any advertisement deemed inappropriate or misleading.
  • Adjust ad placement for website formatting, performance, or editorial reasons, while maintaining comparable visibility.
  • Pause or reschedule campaigns due to technical or operational issues.

Advertising does not influence or determine editorial content. The Border Pulse maintains full and independent editorial control over all published material, and paid advertising will never be exchanged for, or tied to, editorial coverage.

6. Cancellations

Cancellations must be made in writing.

  • If cancelled before publication, a 25% service fee may apply.
  • If cancelled after publication, no refund will be issued for the current billing period.
  • For ongoing ads, please provide 30 days’ notice prior to the cancellation date, unless the Advertiser is under a First-in-Category Discount agreement, in which case 60 days’ written notice is required per Section 2 above.

7. Liability

The Border Pulse shall not be liable for indirect or consequential damages, including loss of revenue or reputation. In any case, liability shall not exceed the amount paid for the advertisement in question.

8. Entire Agreement

Together with a signed Advertising Package Selection form, these Terms & Conditions represent the full agreement between the parties and supersede any prior understanding or discussion. Changes must be made in writing and signed by both parties.

9. Amendments

All changes to these Terms & Conditions, or to an Advertiser’s specific agreement, must be made in writing and completed with the same formality as the original agreement.

10. Digital Communications

All communications exchanged by digital transfer are acceptable. Countersigning once executed by all parties is deemed to constitute one document. Digital agreement to extensions is acceptable.

11. Jurisdiction

These Terms & Conditions will be interpreted under the laws of the Province of Alberta, with the courts of Alberta having jurisdiction.
